Acceptance of Terms

By accessing or using Freshys at https://freshys.app, our apps, or related services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Freshys.

SMS Terms

By providing verbal or written consent to receive SMS messages from Freshys, you agree to receive text messages related to Freshys, including marketplace information, onboarding assistance, requested resources, support, and promotional communications.

Message frequency may vary. Message and data rates may apply.

You may opt out at any time by replying STOP. For help, reply HELP.

Consent to receive SMS messages is not a condition of purchasing goods or services.

Eligibility

You must be at least 18 years old (or the age of majority where you live) to create an account, place marketplace orders, or sell as a farmer on Freshys. By using Freshys, you represent that you meet these requirements and that information you provide is accurate.

Marketplace Role

Freshys operates an online marketplace that connects customers with farms. Farmers list and sell their own products. Customers pay online and arrange pickup or shipping according to each farm’s options. Freshys may also sell packing and shipping supplies to farmers and other buyers. Except where Freshys is the seller of supplies, farms are responsible for their products, fulfillment, and applicable seller obligations.

Farmer Listings

Farmers must provide accurate product descriptions, pricing, inventory, and fulfillment details. Listings must comply with applicable laws and Freshys policies. Freshys may review, suspend, or remove listings or storefronts that violate these Terms, pose safety or compliance risks, or harm the marketplace.

Orders and Payments

When you place an order, you agree to pay the displayed amounts, including applicable taxes, fees, and shipping where charged. Payments are processed by Stripe or other payment partners. Farmer payouts, platform fees, and supplies purchases are handled according to the applicable checkout and seller agreement flows. Freshys may refuse or cancel orders that appear fraudulent, erroneous, or prohibited.

Shipping and Pickup

Fulfillment methods depend on the farm or supplies seller. Pickup times, shipping windows, and carrier choices are set by the applicable seller unless Freshys states otherwise for Freshys-sold supplies. Customers are responsible for providing accurate pickup or delivery information. Freshys is not liable for delays caused by carriers, weather, or incorrect addresses provided by users.

Refunds and Disputes

Refund and dispute handling for farm marketplace orders is generally between the customer and the farm, subject to applicable law and any Freshys-facilitated tools. For Freshys-sold supplies, contact Freshys support. Chargebacks and payment disputes may be reviewed by Freshys and our payment partners. We may request information to resolve issues.

Prohibited Conduct

You agree not to:

• Violate any law or third-party rights
• List prohibited, unsafe, counterfeit, or misrepresented products
• Interfere with Freshys security, payments, or other users
• Scrape, reverse engineer, or misuse the platform except as allowed by law
• Use Freshys for spam, harassment, fraud, or unauthorized commercial messaging

Intellectual Property

Freshys branding, software, and site content are owned by Freshys or its licensors. Farmers and users retain rights in their own content but grant Freshys a license to host, display, and use that content as needed to operate the marketplace. You may not copy or use Freshys marks without permission.

Account Termination

You may stop using Freshys at any time. We may suspend or terminate access if you violate these Terms, create risk for users or Freshys, fail payment obligations, or if we discontinue services. Provisions that by nature should survive (including liability limits, IP, and dispute-related terms) will survive termination.

Disclaimers

Freshys is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service, error-free operation, or the quality of products sold by independent farms.

Limitation of Liability

To the fullest extent permitted by law, Freshys and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Freshys. Our aggregate liability for claims relating to Freshys will not exceed the greater of (a) amounts you paid to Freshys for the service giving rise to the claim in the 12 months before the claim or (b) one hundred U.S. dollars ($100), except where liability cannot be limited by law.

Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Continued use of Freshys after changes take effect constitutes acceptance of the updated Terms.
